Browns Privilege - Terms and Conditions

Browns Privilege is the [Mitchells & Butlers] (‘M&B’) members’ loyalty programme, (“Browns Privilege”). It comprises a range of preferential benefits and offers to its members.  These terms and conditions together with documents referred to (such as our Privacy Policy) govern the entire Browns Privilege and the terms of the contract between [Mitchells & Butlers] (“us”/ “we”) and you (“you”/ “your”). 

Please read them carefully and keep hold of a copy for future reference. If you have any questions about these terms and conditions or Browns Privilege, then please contact us (see FAQs for contact details).

Any application for membership of Browns Privilege or participation in it will be treated as acceptance of these terms and conditions.  Additional terms and conditions may apply for optional elements of Browns Privilege, such as competitions and prize draws.  Members participating in optional elements of Browns Privilege will be considered to have accepted the additional terms and conditions. 

1. Eligibility

  • You must be 18 years of age or over and a UK resident for the entire period for which you are a member. No corporate or business use or membership. Please note that staff may be excluded from certain Browns Privilege events, prize draws and experiences. See individual terms and conditions for events, prize draws and experiences for more information and qualification details.
  • We may refuse an application to join Browns Privilege if we feel there is a good reason to do so.
  • Browns Privilege is only valid in Browns participating premises, (see FAQs for the current list of participating Browns premises).   
  • Each member is entitled to one Browns Privilege Account only.  

2. Browns Privilege - Registration 

  • You can register to become a Privilege Member by either registering your physical card online or downloading the Browns Apps and registering your details via the App.

Browns Privilege Cards  

  • Your Privilege Card must be signed upon receipt and you must not allow anyone else to use it.  Further proof of identification may be requested by the participating Browns premises.
  • The Privilege Card is our property and must be returned to us on request, or destroyed when requested by us.
  • You are responsible for the security of the Privilege Card issued to you. Please treat your Privileged Card as securely as you would cash or a credit card. 
  • If your Privilege Card is lost, or if you think an unauthorised person has become aware of any security code, password or account number, you should contact M&B by email using the contact details set out the FAQs
  • The Privilege Card, in whatever form, is not transferable, cannot be copied and can only be used by the member who is named and registered for the card. 
  • You can pick up a Privilege Card in participating restaurants. As soon as you have your Privilege Card, you are eligible for any benefits that may be made available to you. However, you will not be eligible until you have registered your Privilege Card and received a notification from us that your account has been activated.
  • Your Privilege membership is not transferable once registered It is your responsibility to ensure that all your personal details are kept up to date and M&B will not be responsible for any lost, delayed or undeliverable communications if you do not do so.

3. Privileged Benefits 

  • As a member you may benefit from rewards, offers and promotions personalised for you. Inclusions and exclusions will apply and may change for each rewards, offers and/or promotions. Specific additional terms and conditions may apply to offers and rewards, please see below. 

4. Cancellation or Termination by Us 

  • You can terminate your Browns Privilege membership at any time (see FAQs). On termination any and all benefits accrued (if applicable) will be lost. 
  • We can terminate your Browns Privilege membership immediately if at any time, you are, or we reasonably suspect you may be, acting fraudulently or are in breach of these terms and conditions, if you supply false or misleading information to us or we discover that you are not eligible to be a member of Browns Privilege; or if you are abusive or offensive to any member of our staff.

5. Closing Your Account 

  • You can also close your Browns Privilege Account at any time by contacting us. See FAQs for more details. 
  • If an account is closed for any reason, all or any rewards, offers or promotions relating to that account are lost.

6. Making changes to Browns Privilege 

  • We can make changes to the eligibility requirements, the benefits and the terms of Browns Privilege at any time if we believe the change is to your advantage or, in our reasonable discretion, is required for the continuing administration of Browns Privilege. Material changes will be communicated to you via either SMS, email or postal communication or via the Privileged mobile application. 
  • We reserve the right to withdraw or cancel Browns Privilege at any time giving members seven (7) days’ notice of termination in writing (via email or postal communications). These terms correct as of 31 March 2017. Current terms are available at www.browns-restaurants.co.ukk, which prevail in the case of any difference with these terms.

9. Your information

  • Your personal information obtained by us in connection with Browns Privilege will be used in accordance with applicable data protection legislation and our Privacy Policy/Promise (available at www.browns-restaurants.co.uk). 
  • In particular, it will be used to administer Browns Privilege, provide you with benefits and to keep you updated by email. By joining Browns Privilege, you agree to receive by email updates from us about Browns Privilege and your benefits. You will not be able to opt out of receiving email updates unless you terminate your Browns Privilege membership.

10. Governing Law & Jurisdiction

  • The laws of England and Wales apply to these terms and our dealings with you in connection with Browns Privilege. The terms are in English and any communications we send to you will be in English.

11. Your Statutory Rights

  • Nothing in these terms will affect or reduce your statutory rights, even when from a mobile.

12. Exclusions

  • All reward, offers and promotions are subject to availability.
  • Staff of any participating Browns premises may refuse to serve any person at their sole discretion.
  • Any Browns Privilege rewards, offers and promotions cannot be used in conjunction with any other offers.

13. Privilege Introductory Offers

  • All introductory offers are subject to availability and may change at any time. 

Gift Cards Terms & Conditions

•Gift cards may not be exchanged for cash.

•The card is not a cheque guarantee, credit, debit or charge card.

•No change will be given but the balance can be used for future purchases.

•We will not be held liable for lost or stolen cards - protect this as you would cash.

•To check the balance of your gift card, please click here and follow the simple instructions.

•A gift card is valid for 12 months from the date of purchase.

•Browns gift cards (whether plastic, email or text message) are valid at any Browns venue in the UK as well as any other Mitchells & Butlers venue.  You can search all available venues here: https://www.mbdiningout.co.uk/

•Gift cards can be purchased with a minimum value of £5, up to a maximum of £250.

•SMS and email gift cards should be treated as cash. If deleted, they will not be resent.

•SMS gift cards will be free to receive for the guest.

•Email gifts are valid either presented on a smart phone or printed out.

•SMS and email codes can be used multiple times until all of the remaining balance is spent. You can check the balance of your voucher at https://www.showmybalance.com
